Welcome to Kaffein. Here is a quick summary of our Terms of Service.

Kaffein is the platform to make friends and have conversations. It connects you to various people around you, your friends, families, or even complete strangers, to have conversations like you haven’t had before.

You own the content you post. You also grant us and other users of the Kaffein platform certain rights and license to use it. The details of these licenses are described below under Your Content section.

You are responsible for the content that you post. This includes ensuring that you have the rights needed for you to post that content and that your content does not violate the legal rights of another party (for example, defamation) or any other applicable laws.

We work towards preserving the authenticity and sanctity of relationships. Friendships can only happen if people really connect with others. And, especially in today's world, it is really hard to build trust virtually with an unknown person. People generally strive to talk to their existing friends. Our goal is to strengthen the concept of virtual relationships.

You have an opportunity to earn money. Any and all transactions on Kaffein can be subject to applicable fees and taxes (GST).

We don’t endorse and / or align ourselves with any ideology whatsoever. Our goal is to build a holistic platform where different mindsets and opinions can prevail. Extreme opinions from any users have to be handled at your own discretion.

You agree to follow the rules of our platform. When you use the Kaffein platform, you agree to our Terms and Privacy Policy of our service.

We provide convenient means for you to offer us Suggestions and / or feedback. If you have any input on how we can improve our services or any other feedback.

By accessing this application we assume you accept these terms and conditions. Do not continue to use Kaffein if you do not agree to take all of the terms and conditions stated on this page.

Welcome to Kaffein! It’s time to meet the friends you never had.. Talk with new people and make new memories by building friendships.

Please read the following terms and conditions carefully before registering on, accessing, browsing or using the Kaffein website located at https://kaffein.in or Kaffein Android app located at https://play.google.com/store/apps/details?id=com.dejourn.social (hereinafter collectively, the Kaffein Platform) run by RSC Internet Private Limited, having its registered office at 219/1, K. N. Chatterjee Street, Garulia, Shyamnagar, 24 Parganas, Parganas North, West Bengal, India, 743127 (hereinafter collectively, RSC Internet or Kaffein)

These terms of service (“Terms of Service”) sets forth the agreement (“Agreement”) between you and Kaffein, owned by RSC Internet Private Limited (“Kaffein”, “we” or “us”). It governs your use of the products and services we offer through our application (collectively the “Kaffein Platform”).

Please make sure to read it, because, by using the Kaffein Platform, you consent to these terms.

Kaffein is the platform to have conversations. It connects you to various people around you, your friends, families, or even complete strangers, to have conversations like you haven’t had before.

Using Kaffein Platform

Use - Use of the Kaffein Platform by anyone under the age of 13 is prohibited. Kaffein is an 18+ platform. If you have below 18+, it’s completely your own discretion.

Registration - You need to register yourself to use the Kaffein Platform. When you set up a profile, you will be asked to provide certain information about yourself. You agree to provide us with accurate information, including your real name, when you create your account on the Kaffein Platform. You should take care in maintaining the confidentiality of your passwords and OTPs (One Time Passwords).

After the registration, to use all the features of Kaffein, you will be asked to create a Profile by sharing some basic information such as Bio, Passions, etc. Information that you choose to fill will then undergo our manual review process. You will only be allowed to use Kaffein fully if your profile is with the following terms.

Your profile will get rejected for the following reasons -

You are looking for Dating, Life Partner, Marriage, or any Particular Gender.
You have written Gibberish in your profile.
You hinted at any kind of Solicitation for Sexual Favors, usage of words like Hookups, One-Night Stand, etc.
You haven’t shared anything Interesting about yourself. Say something that will interest other people.
You created a Fake Profile. Make sure your name and your profile picture are true ones or related to your profile information. Your profile picture must have good resolution.
You are Catfishing or your account has been subjected to Suspicious Activities.
You have shared private contact information or email addresses.
Usage of abusive or unparliamentary words.

On Profile Rejection, Kaffein will be closed to you till you edit and submit your profile again.

Privacy Policy - Our privacy practices are set forth in our Privacy Policy. By use of the Kaffein Platform, you agree to accept our Privacy Policy, regardless of whether you are a registered user.

Termination/Suspension - Termination of your Kaffein Account can happen if you are found guilty of the any of the following offenses -

Abusive - Usage of words, actions or media to intimidate, coerce, ridicule, yell, or swear.
Harassment - Usage of improper or unwelcome words, actions or media to cause offense or humiliation.
Sexual Remarks - Usage of words, actions or media of unconsented Sexual nature.
Bullying - Usage of words, actions or media seeking to harm, ridicule, or intimidate.
Creepy - Usage of words, actions or media to cause an unpleasant feeling of fear or unease.
Hate Speech - Usage of words, actions or media to incite hatred against a group of persons defined in terms of race, gender, ethnicity, sexual orientation, or religious belief.
Spam - Over Usage of unsolicited or unwanted words, actions or media.
Scam - Usage of words, actions or media to deceive mainly but not limited to financial and legal reasons.
Threats - Usage of words, actions or media to deliberately frighten or have hostile behavior.
Suspicious - Usage of words, actions or media to cause one to have the idea or impression that someone or something is questionable, dishonest, or dangerous.
Stalking - Usage of words, actions or media to harass or persecute with unwanted and obsessive attention.
Trolling - Usage of words, actions or media to deliberately cause upset or uncomfortability in others.
Catfish - Usage of words, actions or media to deliberately impersonate someone else to trick or attract others.
Duplicating Accounts - Creating multiple accounts to circumvent restrictions or suspensions in alternative accounts or to scam, spam others.

Apart from the above reasons, your account can be Terminated or Suspended permanently if you faced more than one Restrictions.

Restrictions meaning not being able to access Kaffein for 24 hours. In usual cases, you will be Restricted first if you are found guilty of the above mentioned reasons but in extreme cases, if the magnitude of your actions are extreme (solely decided based on the discretion of the team of Kaffein), you can be permanently Suspended or Terminated.

You can always challenge our verdict if you feel we made a mistake. To challenge our verdict, you need to write us an email at kaffein.dejourn@gmail.com. You need to provide 2 things to be eligible for challenging -

You need to provide the credentials (email addresses/phone number) with which you had created the Kaffein account.
You need to provide your Reason in a detailed manner to share why you think we made a mistake in our verdict.

After the challenge, a special team will be appointed to look into the situation and their verdict will be Final and Non-negotiable.

Deletion - To Delete your Account along with your Data, you can request Account Deletion by visiting the Delete Account option from Settings. Any requests of account deletion gets processed everyday at 6AM IST. Before it gets processed, you can cancel the request for account deletion at any point of time.

Changes to the Kaffein Platform - We are always trying to improve your experience on the Kaffein Platform. We may need to add or change features and may do so without notice to you.

Feedback - We welcome your feedback and suggestions about how to improve the Kaffein Platform by sending us an email at kaffein.dejourn@gmail.com or by talking with us directly on Kaffein as well. By submitting feedback, you agree to grant us the right, at our discretion, to use, disclose and otherwise exploit the feedback, in whole or part, freely and without compensation to you.

Buttons, Links and Widgets - You have permission to use Kaffein's buttons, links, and widgets, subject to these Terms of Service and provided that: (a) your use of such buttons, links and widgets link only to the Kaffein Platform; (b) you will not modify such buttons, links, or widgets or associated code in any manner; (c) you will not use any such buttons, links, or widgets in any manner which implies or suggests that Kaffein endorses, sponsors, or recommends the website on which such buttons, links, and widgets are used.

Your Content

Definition of Your Content - The Kaffein Platform enables you to create stories, pulses, clubs and messages using texts, photos (if applicable), and links to share with others. All material that you upload, publish or display to others via the Kaffein Platform will be referred to collectively as “Your Content.” You acknowledge and agree that, as part of using the Kaffein Platform, Your Content may be viewed by the general public.

Permission to Use Your Content -

By submitting, posting, or displaying Your Content on the Kaffein Platform, you grant Kaffein the permission to use, copy, reproduce, process, adapt, create derivative works from, publish, transmit, store, display and distribute, translate, communicate and make available to the public. This license also includes the right for other users of the Kaffein Platform to use, copy, reproduce, adapt, create derivative works from, publish, transmit, display, and distribute, translate, communicate and make available to the public Your Content, subject to our Terms of Service.

Once you create your content on Kaffein, you may have the chance to edit or delete your creation. However, we will not be able to control the modification and/or the removal of the content from display on any other previously distributed methods outside of Kaffein. Once you create content, no one other than you can modify the content. But if your content violates the terms of service, the Kaffein Platform can remove your content at any time.

Your Responsibilities for Your Content - By posting Your Content on the Kaffein Platform, you represent and warrant to us that: i) you have the ownership rights, or you have obtained all necessary permissions from any necessary parties, to use Your Content and grant us the rights to use Your Content as provided for under this Agreement, and ii) that posting Your Content violates no intellectual property or personal rights of others or any applicable law or regulation. You accept full responsibility for avoiding infringement of the intellectual property or personal rights of others or violation of laws and regulations in connection with Your Content.

Moderating Your Content - You are the owner of your content but as the platform owner, we will work towards maintaining a certain standard of the information that is shared on Kaffein Platform. Every user will have the necessary tools to report and remove the contents which constitute the following attributes -

Abusive - Usage of words or media to intimidate, coerce, ridicule, yell, or swear.
Clickbait - Usage of words or media or links to attract attention to deceive or mislead.
Harassment - Usage of improper or unwelcome words or media to cause offense or humiliation.
Harmful - Usage of words or media to cause injury or detrimental effect on someone’s physical, psychological, or emotional well-being.
Hate Speech - Usage of words or media to incite hatred against a group of persons defined in terms of race, gender, ethnicity, sexual orientation, or religious belief.
Pornography - Usage of words or media or links of sexual activity solely to excite lascivious feelings of a particularly blatant and aberrational kind.
Provocative - Usage of media or words which are purposefully provocative in nature to invoke a sense of violence, sexual emotion, suspicious, abusive, hate speech, scam, harassment, harmful.
Propaganda - Usage of words or media to influence or manipulate the behavior of people in a certain predefined way.
Scam - Usage of words or media to deceive mainly but not limited to financial and legal reasons.
Self Harm - Usage of words or media to deliberately injure oneself physically, psychologically, or emotionally.
Spam - Over Usage of unsolicited or unwanted words or links or media.
Violence - Usage of words or media intended to cause physical harm, damage, or kill.

If you don’t find an appropriate objectionable element from the list for a content, you will always have an opportunity to report and remove a content by sharing your reasons. We will update our objectionable behavior list accordingly.

If any users object to your content by reporting/blocking, the content will be under review process and might be taken down permanently, if necessary. And if your content receives repeated reporting from the community, you might lose your Kaffein account permanently.

Along with the users, our own content moderator team will also review all the content shared on the platform. If your content is flagged by our content moderation team, depending on the content, your account might get terminated without a warning.

Our Content and Materials

Definition of Our Content and Materials - All intellectual property in or related to the Kaffein Platform (specifically including, but not limited to our software, the Kaffein logo, but excluding Your Content) is the property of Kaffein, RSC Internet Private Limited (collectively “Our Content and Materials”).

Our License to You -

We grant you a limited, non-exclusive license to use and access Our Content and Materials and Data as made available to you on the Kaffein Platform in connection with your use of the Kaffein Platform, subject to the terms and conditions of this Agreement.

Kaffein gives you a worldwide, royalty-free, revocable, non-assignable and non-exclusive license to repost Our Content and Materials anywhere on the web provided that: (a) you do not modify the content; (b) you attribute Kaffein by name in readable text and with a human and machine-followable link (an HTML <a> anchor tag) linking back to the page displaying the original source of the content on https://kaffein.in on every page that contains Our Content and Materials; (c) upon request, either by Kaffein or a user, you remove the user's name from content which the user has subsequently made anonymous; (d) upon request, either by Kaffein or by a user who contributed to the content, you make a reasonable effort to update a particular piece of content to the latest version on the Kaffein Platform; and (e) upon request, either by Kaffein or by a user who contributed to the content, you make a reasonable attempt to delete content that has been deleted or marked as not for reproduction on the Kaffein Platform; (f) you don’t republish more than a small portion of Our Content and Materials. In exercising these rights, you may not implicitly or explicitly assert any connection with, sponsorship or endorsement by Kaffein, or any Kaffein user, without separate, express prior written permission from us.

We may terminate our license to you at any time for any reason. We have the right but not the obligation to refuse to distribute any content on the Kaffein Platform or to remove content. Except for the rights and license granted in these terms, we reserve all other rights and grant no other rights or licenses, implied or otherwise.

Permitted Uses - If you operate a search engine, web crawler, bot, scraping tool, data mining tool, bulk downloading tool, widget utility, or similar data gathering or extraction tool, you may access the Kaffein Platform, subject to the following additional rules: i) you must use a descriptive user agent header; ii) you must follow robots.txt at all times; iii) your access must not adversely affect any aspect of the Kaffein Platform’s functioning; and iv) you must make it clear how to contact you, either in your user agent string, or on your website if you have one.

No Endorsement - Kaffein as a platform will always focus on building and developing new engagements, features, and tools for the users to empower themselves and the platform. Please note that it is a platform that welcomes all the different viewpoints, even if it’s very extreme but the Kaffein Platform doesn’t and will not endorse any viewpoints and thoughts. We make no warranties or representations about the accuracy, completeness, or timeliness of any content posted on the Kaffein Platform by anyone.

Ownership - You acknowledge and agree that Our Content and Materials remain the property of Kaffein's users or Kaffein.

Earning From Kaffein

Kaffein, as a platform, will always focus on keeping the platform clean and productive. In order to do so, we are going to empower our users with exclusive opportunities to earn from Kaffein.

Users are responsible for reviewing and understanding the terms associated with financial transactions on Kaffein, as well as any additional terms set forth by relevant payment processors.

Currently, there is 1 way to earn from Kaffein -

Creation of Premium Clubrooms - Users can share valuable content through a feature called Clubs and earn from subscriptions. Earnings from premium clubrooms subscriptions will be subject to applicable fees and taxes (GST).

Refund From Kaffein - Kaffein has an in-app currency named “Kaffein Coin.” Kaffein coin helps you to explore premium features and experiences of Kaffein. Each Kaffein coin costs ₹1.

If you send a request to someone using Kaffein coins after purchasing it and then you or the other party quit the request and leave, the Kaffein coin or the money will not be refunded to you.

Refunds of Kaffein coins are only applicable if you use Kaffein coins and then use our feature “Discovery” to find people but are unable to find anyone.

Cookies

We employ the use of cookies. By accessing Kaffein, you agreed to use cookies in agreement with the RSC Internet Private Limited's Privacy Policy.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website/application to enable the functionality of certain areas to make it easier for people visiting our website/application. Some of our affiliate/advertising partners may also use cookies.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website/application and the use of this website/application. Nothing in this disclaimer will:

limit or exclude our or your liability for death or personal injury;
limit or exclude our or your liability for fraud or fraudulent misrepresentation;
limit any of our or your liabilities in any way that is not permitted under applicable law; or
exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

As long as the website/application and the information and services on the website/application are provided free of charge, we will not be liable for any loss or damage of any nature.

Indemnification

You agree to release, indemnify, and defend Kaffein Entities from all third-party claims and costs (including reasonable attorneys’ fees) arising out of or related to - i) your use of the Kaffein Platform, ii) Your Content, iii) your conduct or interactions with other users of the Kaffein Platform, or iv) your breach of any part of this Agreement. We will promptly notify you of any such claim and will provide you (at your expense) with reasonable assistance in defending the claim. You will allow us to participate in the defense and will not settle any such claim without our prior written consent. We reserve the right, at our own expense, to assume the exclusive defense of any matter otherwise subject to indemnification by you. In that event, you will have no further obligation to defend us in that matter.

Dispute Resolution

This Agreement and any action arising out of your use of the Kaffein Platform will be governed by the laws of India without regard to or application of its conflict of law provisions or your state or country of residence. Unless submitted to arbitration as set forth in the following paragraph, all claims, legal proceedings or litigation arising in connection with your use of the Kaffein Platform will be brought solely in Kolkata, India, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

General Terms

Changes to these Terms - We may amend this Agreement at any time, in our sole discretion. If we amend material terms to this Agreement, such an amendment will be effective after we send you the notice of the amended agreement. Such notice will be at our sole discretion, and the manner of notification could include, for example, via email, posted notice on the Kaffein Platform, or another manner. Your failure to disable your account, after receiving notification of the amendment, will constitute your acceptance of the amended terms. If you do not agree to the amendments or to any of the terms in this Agreement, your only remedy is to disable your account on the Kaffein Platform.

Governing Law and Jurisdiction - You agree that Kaffein is operated in India and will be deemed to be solely based in West Bengal and a passive service for purposes of jurisdictional analysis. For any claims for which arbitration is inapplicable, you agree that such claims will be brought in the Supreme Court or High Court of Kolkata, West Bengal and governed by laws of India, without regard to any conflict of law provisions.

Survival - The following provisions will survive expiration or termination of this Agreement: Feedback in Using Kaffein Platform, Your Content, Our Content and Materials, Disclaimers, Indemnification, Dispute Resolution, and General Terms.

Electronic Communications - You consent to receive communications from us by email in accordance with this Agreement and applicable law. You acknowledge and agree that all agreements, notices, disclosures and other communications that we provide to you electronically will satisfy any legal requirement that such communications be in writing.

Entire Agreement/ Severability - This Agreement supersedes all prior terms, agreements, discussions, and writings regarding the Kaffein Platform and constitutes the entire agreement between you and us regarding the Kaffein Platform (except as to services that require a separate written agreement with us, in addition to this Agreement). If any provision in this Agreement is found to be unenforceable, then that provision will not affect the enforceability of the remaining provisions of the Agreement, which will remain in full force and effect.

Interpretation - In construing or interpreting the terms of this Agreement: (i) the headings in this Agreement are for convenience only, and are not to be considered, and (ii) no presumption is to operate in either party’s favor as a result of its counsel’s role in drafting this Agreement.

Relationship - This Agreement does not create a joint venture, agency, partnership, or other forms of joint enterprise between you and us. Except as expressly provided herein, neither party has the right, power, or authority to create any obligation or duty, express or implied, on behalf of the other.

Waiver - No waiver of any terms will be deemed a further or continuing waiver of such term or any other term. Our failure to assert a right or provision under this Agreement will not constitute a waiver of such right or provision.

Further Assurances - You agree to execute a hard copy of this Agreement and any other documents, and to take any actions at our expense that we may request to confirm and effect the intent of this Agreement and any of your rights or obligations under this Agreement.
